By accessing, viewing, or using the All Set To Jet, LLC (hereinafter referred to as “ASTJ Adventures,” “we,” “us,” or “our”) website, you acknowledge that you have read, understood, and do thereby agree to be bound by the Terms and Conditions herein (the “Terms”). The Terms constitute a legal contract between you and ASTJ Adventures and shall govern all use of the website, and the accessing and use of all content, services, and information provided on this website. ASTJ Adventures may update the Terms with or without separate notice to you. Each time you access this website, you agree to be bound by the Terms then in effect. If you do not agree to the Terms, you should not use, view, or further access this website or our services.
We specialize in providing travel experiences to solo female travelers (“traveler” and “you”). By booking a trip with ASTJ Adventures you are deemed to have agreed to these Terms and Conditions and the terms and conditions of our suppliers (which constitutes the entire agreement between you and us) and your booking will be accepted on this basis.
Bookings
You may request Services with ASTJ Adventures by accepting our quote in writing and delivered to us, but the contract between ASTJ Adventures and you is formed when:
Rates and Reservation Information
Rates are per person and single occupancy, unless otherwise noted. Rates are guaranteed at the time that the deposit is received by ASTJ Adventures. Until such time, rates are subject to change.
Our travel collection features comprehensive tours to various destinations throughout the world. The rates generally include expert leadership, accommodations, arrival airport transfers, breakfast daily and meals as outlined in the tour itinerary, ground transportation, local guides, entry fees & tickets to activities, sightseeing as noted in the tour itinerary, and support staff.
The rates do not include any other items such as air travel, airline fees, airport or departure taxes, departure airport transfers, visas, customary gratuities, required travel insurance, driver, local guides, hotel housekeepers, cruise ship waitstaff, meals other than those specified in the itinerary, optional activities, and any incidental charges. Each tour varies slightly.
Payments
After applying for a tour on the website, space permitting, you will receive an official invitation email for that tour. In order to reserve your place on said tour, an initial 25% non-refundable deposit is due within forty-eight (48) hours of receipt of your invitation email. The invitation email will include instructions to pay your deposit. If your booking is made within ninety (90) days of the scheduled departure date, then payment in full for the tour will be required at the time of booking.
Prices are in U.S. dollars. All payments must be made by cash, check, wire or charge to any major credit card company (Visa, MasterCard, or American Express). Credit card transactions may be subject to an additional processing fee of up to 4%.
After we receive your initial deposit, ASTJ Adventures will provide you with detailed pre-tour information including travel insurance requirements, a packing list, visa information (if required), and any additional COVID-19 requirements. A final, detailed tour itinerary will be provided approximately one week prior to the scheduled tour.
The remaining payment will be due 90 days prior to the scheduled trip departure. ASTJ Adventures requires payment in full prior to the tour. All payments are non-refundable and non-transferable. If the payments are not made on or before their respective due dates, we reserve the right to treat your booking as cancelled, and we will not be held liable for any refunds, tour credits, costs, expenses, travel insurance costs, airfare, visa fees, inoculations, etc. related to your booking or preparation for your scheduled tour. If full payment is not received by the due date, then rates and space cannot be guaranteed and ASTJ Adventures has a right to cancel your experience and keep any and all deposits.
ASTJ Adventures shall not be responsible for any charges applied to credit card transactions and shall not refund or return any fees by third parties as incurred during the transaction of the adventure cost. If you request a refund that falls within our refund policy, and have paid using a credit card, a refund will be granted less 3% for transaction fees and less 4% for non-US credit cards.
Travel Protection/Insurance
Travel insurance protection is mandatory for all our travelers and should be taken out at the time of booking. We strongly encourage the purchase of additional Cancel for Any Reason Coverage. Travel Protection Plans including cancel for any reason coverage must be purchased in close conjunction with your travel purchase, so you should contact your insurance agent as soon as possible after booking.
Proof of travel insurance is required prior to participating in any ASTJ Adventures tour, covering all applicable dates of travel. We do not accept credit card insurance as proof of travel insurance for our tours. Travel insurance should include a minimum medical coverage of $100,000 USD and this insurance should cover personal injury, emergency medical expenses, medical evacuation coverage, trip cancellation and interruption, as well as baggage loss. You are strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling. You acknowledge that insurance coverage is not included in the cost of any tour offered by ASTJ Adventures and you are required to obtain separate coverage at an additional cost. When obtaining travel insurance, you must ensure that the insurer is aware of the type of travel to be undertaken.
Since ASTJ Adventures does not offer refunds, if you elect to cancel for any reason other than ASTJ Adventures cancelling or being unable to offer the tour, you should file a claim with your travel insurance provider to determine if they will cover any payments already made to ASTJ Adventures. As payments made to ASTJ Adventures are non-refundable, you should consider adding appropriate cancellation coverage to your policy.
Once you have purchased your travel insurance policy, you will be required to provide a copy of the policy to ASTJ Adventures via email at bookings@allset2jet.com.
You must provide your travel insurance policy number and the insurance company’s 24 hour emergency contact number 30 days prior to the start of your trip; you will not be able to join the trip without these details.
ASTJ Adventures is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. ASTJ Adventures cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer, insurance agent or broker.
Certain countries have a requirement for foreign visitors to have valid medical insurance upon entry. ASTJ Adventures cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance or denial of entry for any reason. Failing to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without adequate coverage, there may be no way to recoup any losses, costs or expenses incurred.
Travel Documents
It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure, and travel through each destination point along the itinerary of the adventure. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits, and certificates (including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid for 6 months after the last date of travel with ASTJ Adventures as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas, and permits prior to the start of the tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by ASTJ Adventures that is a direct result of your failure to secure or be in possession of proper travel documentation. ASTJ Adventures makes no representations or warranties as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that ASTJ Adventures is not responsible for any errors or omissions in this information.
Cancellations By You
All tour payments are non-refundable and non-transferable. As a result, ASTJ Adventures requires that you purchase travel insurance for coverage in the event of a medical or family emergency, or for any other basis that you deem necessary.
No tour credits, date changes or refunds will be provided in the event you decide to cancel your tour/booking, do not arrive to your scheduled tour on the anticipated start date, or in the event you arrive late to any tour.
Similarly, no refunds will be given for unused hotel rooms, meals, activities, or excursion arrangements for any reason whatsoever. Tours are quoted as a package and refunds and discounts or credits are not given for services missed or unused, including your voluntary or involuntary termination/departure from the experience which includes but is not limited to: sickness, death of a family member, late arrival on the trip to premature departure either voluntarily or involuntarily.
Cancellations, Delays, or Changes By Us
ASTJ Adventures reserves the right to cancel any trip due to inadequate enrollment or other cause that makes the trip unfeasible for us to operate. We will inform you at least 21 days prior to departure if a trip is cancelled.
In such instances, where ASTJ Adventures cancels your trip, a full travel credit toward a future tour or refund of the tour cost is given, except in those instances such as if: (i) a tour is cancelled due to force majeure (acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; labor strikes; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable), where prepaid deposits and payments cannot be returned or reversed, or (ii) where ASTJ Adventures has already disbursed full payment for the services or transportation purchased by you to its third-party suppliers or providers.
For any tour that is instead delayed or postponed by ASTJ Adventures, ASTJ Adventures agrees to provide alternate travel dates for that tour, or reserves the right to offer a travel credit towards future travel, at its sole discretion. Any travel credit provided for a delayed or postponed tour, will be equivalent to the rate you paid to ASTJ Adventures for your booking/tour. Your travel credit does not expire. Your travel credit may also be used towards another ASTJ Adventures tour destination. However, you will be responsible for paying for any difference in the rate related to that destination.
ASTJ Adventures is not responsible for expenses incurred by you in preparing for a cancelled, delayed or postponed tour (e.g., non-refundable purchase of air tickets, travel insurance costs, visa fees, inoculations, equipment, etc.) or for any additional arrangements should you depart prior to the scheduled tour departure date.
Published times on itineraries are as accurate as possible, but are subject to change due to traffic, weather, mechanical and any other conditions beyond the control of ASTJ Adventures that prevent ASTJ Adventures from operating as scheduled. ASTJ Adventures expressly disclaims any liability for any damages that may be incurred for any changes, cancellations, delays, or additional costs related to any tour itinerary.
All services and accommodations are subject to the laws of the country in which they are provided. ASTJ Adventures reserves the right to make changes in the tour itinerary or program features whenever, in their sole judgment, with or without notice, conditions warrant, or if ASTJ Adventures deems it necessary for the comfort, convenience, or safety of the tour.
Baggage
Although every effort is made to handle your luggage as carefully as possible when in our possession, ASTJ Adventures is not responsible for and does not assume liability or accept claims for loss of or damage to luggage due to breakage, theft or wear and tear through airline/airport, hotel and group carrier handling, or at any time while on an ASTJ Adventures tour. For this reason, and others, it is required that you have adequate travel insurance to cover these possibilities.
Please contact your airline or refer to its website for detailed information regarding your airline’s checked baggage policies, including size and weight limitations, and baggage fees.
Airlines
ASTJ Adventures tour pricing does not include airfare. The passage contract in use by the airline concerned, when issued, shall constitute the sole contract between the airline and you, as it relates to any ASTJ Adventures tour. Please read the terms and conditions related to the airline ticket you purchase.
ASTJ Adventures is not liable for incidents involving airline safety, risk, delays, etc., or incidents that result in injury, delay, or death. Additionally, ASTJ Adventures shall not be required to issue any refunds to you for any unused portion(s) of your tour related to any airline delay or other delay outside the control of ASTJ Adventures.
Medical and Health
You must provide any medical information reasonably requested by ASTJ Adventures and may be required to complete a medical questionnaire or other related forms prior to the tour. ASTJ Adventures reserves the right to challenge any information submitted, ask for further information or clarity on certain points, or reasonably reject or rescind a booking based on the medical information presented to us. In the event that you have made a booking with ASTJ Adventures and are subsequently unable to complete the required medical form for any reason by the dates specified in the documents or payment invoice, we reserve the right to treat the booking as cancelled, and applicable cancellation penalties apply.
ASTJ Adventures has the right to disqualify you at any time during the tour if it believes you are physically or mentally unable to participate in the tour or if your continued participation may jeopardize any other individuals in the tour group. Refunds are not given under such circumstances. You agree to complete the medical questionnaire and any related forms honestly and to disclose all relevant medical information accurately and fully. In the event that there is a dispute between us and you in regard to your physical or mental suitability for the experience, the matter will be referred to a medical professional at your expense.
You acknowledge that hospital facilities are often unavailable, and evacuation can be prolonged, difficult and expensive. You also acknowledge that medical facilities abroad may not be of the same standard and quality of service as medical facilities in the United States or your home country. ASTJ Adventures makes no representations and gives no warranties in relation to the standard of such treatment. You agree and acknowledge the risks, dangers, and limited availability or lack of any medical care associated with such travel and, together with all limitations of liability found in this document and the Contract Documents including those found in Medical Information and Release Form, absolve ASTJ Adventures of any liability of such risks, dangers and failure to provide medical care.
You further acknowledge that such travel may be dangerous and involve the risk of injury, sickness or possibly death, as well as damage to property. You acknowledge that you may be traveling to very primitive areas, with high risk of violence due to crime, war, terrorism, political unrest, and other dangers, and may be exposed to various diseases (food, water-borne or otherwise). We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.
We must be notified in writing at the time of booking of any medical conditions, pregnancy, physically or mentally challenged conditions or disabilities which may affect fitness to travel. We shall not be held liable for your failure to notify us of any such conditions, and you assume all risk for failure to disclose all aforementioned medical conditions. Your failure to notify us of such conditions may result in you being refused travel, in the case, that results in cancellation, 100% of the cancellation fees are your responsibility. For safety reasons, we may refuse to carry pregnant women or those with certain mental or physical conditions. We are not required to provide any special facilities unless it has been agreed to do so in writing. We will do our best to meet your special requests including dietary, but such requests do not form part of the Contract and therefore we are not liable for failing to provide these requests.
It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your tour, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking.
ASTJ Adventures will communicate requests to suppliers, but cannot be responsible if ADA accommodations are not available. Any accommodations provided will be at the sole expense of the traveler requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility. We may request that you provide a letter from your doctor confirming your fitness to travel.
The State Department (www.travel.state.gov) and the US Centers for Disease Control and Prevention (www.cdc.gov) periodically issue statements, advisories, and warnings about risks to travelers. These statements are country-specific and contain important information. We strongly urge you to review any State Department warnings, alerts, advisories, and destination specific information at www.travel.state.gov as well as specific health information for the destination at www.cdc.gov. Please also refer to the CDC website to make sure you are up to date on all required vaccines.
Age Requirements
You must be at least twenty-one (21) years of age on the date the tour begins, in order to participate.
Photography and Film Records
You understand and agree that ASTJ Adventures reserves the right to take photographic or film records of any of its tours that may include you, and that it may use any such photographic or film records for promotional and/or commercial purposes without payment of any compensation to you. You further understand and agree that any such photographic or film records may be used by any third-party with whom ASTJ Adventures may engage for the purpose of joint marketing, without any remuneration to you. You grant us perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.
Responsibilities of Tour Participants
You have certain responsibilities to ASTJ Adventures and to other tour participants. You are responsible for understanding the conditions stated in the tour itinerary and selecting a tour in consultation with ASTJ Adventures that is appropriate to your interests and abilities, and for preparing for the tour by reading the ASTJ Adventures tour itinerary provided to you.
Additionally, you agree to arrive on time for the tour and all tour related activities. No reimbursements, discounts or refunds will be issued for services that are missed or unused due to no fault of the ASTJ Adventures, including your removal from a tour because of your negligence or breach of these Terms.
You must at all times strictly comply with all applicable laws and regulations of all countries and regions. You further agree to follow all written and verbal rules of safety presented to you by ASTJ Adventures and the independent contractors it employs. You understand and agree that ASTJ Adventures reserves the right to refuse you as a tour participant, or remove you from any tour, without refund or liability, if it judges you to be incapable of meeting the rigors and requirements of participating in the activities, due to illness or otherwise, or due to any illegal, abusive or disrespectful behavior, or for any other reason it deems necessary and appropriate.
You are responsible for any costs (including repair, replacement and cleaning fees) incurred by ASTJ Adventures or the ASTJ Adventures third-party suppliers for property damage, destruction or theft caused by you while on a tour. You agree to immediately report any pre-existing damage to a representative of ASTJ Adventures and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.
You agree to take all prudent measures in relation to your own safety while on tour including, but not limited to: the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither ASTJ Adventures nor its third-party suppliers are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
Complaints
We endeavor to provide our services to the highest of standards. However, should you encounter any problem or issue with the services, you agree to bring any complaints to us as soon as possible in order to provide us the opportunity to properly address such complaints. ASTJ Adventures assumes no liability for complaints that are not properly brought to our attention and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a tour must be received in writing by the ASTJ Adventures within thirty (30) days of the last day of travel related to the tour. ASTJ Adventures will not accept any liability for claims received after this period.
Local Conditions
You acknowledge that you will be visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges greater than those present in your daily lives. By booking travel with us, you acknowledge that you have considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such travel conditions. You are solely responsible for acquainting yourself with customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary, and are encouraged to locate or make contact prior to embarkation with your local embassy or consulate in each destination.
Authority On Tour
Our group trips are run by an ASTJ tour guide. The decision of the tour guides are final on all matters likely to affect the safety or well-being of any traveler or staff member participating in the trip. If you fail to comply with a decision made by a tour guide, or interfere with the well-being or mobility of the group, the tour guide may direct you to leave the trip immediately, with no right of refund.
We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
Not Liable for Third Party Suppliers
ASTJ Adventures, its owners, directors, officers, employees and affiliates, (collectively ASTJ Adventures) do not own or operate any entity which is or does provide goods or services for your tour including, for example, ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional or included excursions or equipment used thereon, food service or entertainment providers, etc. Although ASTJ Adventures takes all reasonable care in selecting third party suppliers, ASTJ Adventures is unable to control third party suppliers, does not supervise third party suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by third-party suppliers related to your booking are subject to terms and conditions imposed by these third-party suppliers.
As a result, ASTJ Adventures assumes no responsibility for and cannot be held liable for any claim, personal injury, death, property damage or other loss, accident, delay, inconvenience, irregularity, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party, other than that of ASTJ Adventures and its employees. ASTJ Adventures is not liable for the acts or omissions, whether negligent or otherwise, of third-party suppliers or any independent contractors.
Additional Limitations of Liability
Without limitation, ASTJ Adventures is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to: acts of God; acts of government; force majeure; acts of war or civil unrest; insurrection or revolt; strikes or other labor activities; criminal or terrorist activities of any kind, or the threat thereof; overbooking or downgrading of accommodations; structural or other defective conditions in hotels or other lodging facilities; mechanical, or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely; hazards associated with travel to foreign countries including undeveloped areas; dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort; dangers incident to recreational activities such as scuba diving, zip lining, snorkeling, paddle boarding, surfing, swimming, kayaking, sailing, canoeing, horseback riding, rafting, whitewater rafting, hiking, bicycling, canyoning/canyoneering, fishing, snowshoeing, cruising, camping, helicopter tours, 4×4 Jeep/ATV tours, snowmobiling activities, hot air ballooning, jetboating, mule riding, dogsledding, cross-country skiing, rock climbing, etc.; sanitation problems; food poisoning; lack of access to or quality of medical care; difficulty in evacuation in case of a medical or other emergency; illness; the adequacy of medical attention if and when provided; epidemics or the threat thereof including, but not limited to, exposure to COVID-19 by any means of transmission, including any mutation or variation of, and the ongoing effects of, Covid-19; epidemics or the threat thereof; or for any other cause beyond the direct control of ASTJ Adventures.
You are voluntarily participating in the tour with ASTJ Adventures, and as lawful consideration for the agreement to travel with ASTJ Adventures, you hereby understand and accept the risks and uncertainty involved in participating in any tour. You hereby accept and agree to hold harmless and release ASTJ Adventures, its related companies, officers and employees from any and all suits, actions, losses, damages, claims or liability for any personal injury, death, property damage or other loss, accident, delay, inconvenience or irregularity which is occasioned by any negligent acts or omissions of ASTJ Adventures tours related thereto, or otherwise, including negligence of other persons and companies known or unknown, or of willful or criminal conduct of third parties.
Binding Arbitration
You agree that if any dispute relating or referring to these Terms, the tour itinerary, or any other literature concerning the tour, or the tour itself cannot otherwise be informally resolved through informal negotiations or mediation, that the dispute shall be resolved exclusively by binding arbitration before one arbitrator located in Boston, Massachusetts. Any party or their representative may appear for the arbitration by telephone or video conference. Each party shall bear its own fees, costs and expenses and an equal share of any arbitrator and administrative fees; however, the prevailing party shall be entitled to full recovery of all such costs and fees.
Disputes shall be arbitrated on an individual basis, with there being no right or authority for any disputes to be arbitrated on a class action basis or in a purported representative capacity on behalf of the general public, other third-party travel suppliers or other entities similarly situated. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of these Terms, including but not limited to any claim that all or any part of these Terms are void or voidable. You understand that by agreeing to these Terms, you and ASTJ Adventures are waiving their rights to a jury trial.
Optional Extras
“Optional Extras” refers to any activity, transportation, meal, product or service not expressly included in the tour itinerary or price of the tour, and which does not form part of the tour. You agree that any assistance given by any ASTJ Adventures representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and ASTJ Adventures makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of ASTJ Adventures regarding any Optional Extras. You release ASTJ Adventures from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.
You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury, or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.
COVID-19 Vaccination and Testing
Effective January 1, 2023, ASTJ Adventures will not require that you provide proof of vaccination against COVID-19. However, you acknowledge that you are choosing to travel at a time when you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip.
We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.
If at any time during the tour you are diagnosed with COVID-19, you will be asked to isolate yourself from the rest of the tour at your sole cost and expense, in accordance with any local laws or ordinances. All costs associated with your testing, isolation, quarantine, and/or medical care are your sole responsibility. You agree that due to uncertainty caused by COVID-19, we strongly encourage the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, we shall not be liable to any losses whatsoever arising.
Severability
In the event that any term or condition contained herein is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.
Successors and Assigns
These Terms and Conditions shall inure to the benefit of and be binding upon ASTJ Adventures and you and your respective heirs, legal personal representatives, successors and assigns.
Errors and Omissions
Although we have made a concerted attempt to verify the accuracy of statements made herein, we cannot be held responsible for any error, omission or unintentional misrepresentation that may appear in brochures, travel documents, or on the website.
Updating of Terms and Conditions
ASTJ Adventures reserves the right to update and amend these terms and conditions at anytime. It is your responsibility to keep updated with any changes. The current version of terms and conditions will always be found on the website www.allset2jet.com and will be the terms referred to in any dispute.
Surcharges
We reserve the right to impose surcharges up to 30 days before departure due to unfavorable changes in exchange rates, increases in transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. If any surcharge results in an increase of more than 15% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund.
Accommodation
All accommodations are in single rooms. Special requests such as lower floors and smoking preference, must be made at the time of booking. While we will make reasonable efforts to communicate your requests to the supplier, such requests are not guaranteed and are at the discretion of the supplier. There may be additional charges for such requests which will be solely the expense of the guest making the request.
Travelers should be aware that hotel room sizes, standards and facilities can vary regionally and are often different from standards in the United States. This can include difference in bed sizes and room sizes, bathroom amenities, amenities such as air-conditioning and compliance with other standards such as ADA and wheelchair accessibility.
We reserve the right, if necessary, to substitute other similar hotels for hotels listed on your itinerary. Such substitutions may be made at any time and without prior notice. We cannot be held responsible for hotel over-bookings; should such occur, we will undertake to find similar accommodations in the same area. Such substitutions are at our sole discretion and no refunds will be offered for changes in accommodations.
While we exercise due diligence in the selection of our partners, hotel and other accommodation profiles are based on information provided to us by the supplier. This includes images and descriptions of the properties and rooms. Additionally, travelers should be aware that star ratings or similar systems are based on country classifications and therefore can differ. While we do our best to maintain current and accurate information regarding these suppliers, we cannot be held responsible for any inaccuracies in supplier descriptions, amenities, or images.
Food and Meals
Included meals are as indicated in the itineraries. Special diets should be requested at the time of booking; however, it may not be possible for special diets to be catered to in some of the destinations. For safety and liability reasons, we and our representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and are not responsible for any issues or problems associated with the same. We will advise the hotels of your request, but we cannot guarantee their availability.
Disputed Charges and Chargebacks
In certain cases, you have the ability to dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. We retain the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:
This Agreement shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts without regard to applicable conflict of law provisions.
